2. Use of the App & AI Content

• The App allows you to create and review flashcards and quizzes from your notes.
• AI Transparency: Quizzes and flashcards are artificially generated using third-party AI systems (e.g., Google Gemini).
• Accuracy & Verification: While we strive for high-quality generation, AI can make mistakes. You are ultimately responsible for verifying facts and information before relying on them for exams, medical, legal, or other critical purposes. We are not liable for any inaccuracies in AI-generated content.
• You agree not to misuse the App, including uploading illegal, harmful, or infringing content.
• We may suspend or terminate accounts that violate these Terms.

3. Accounts

• You can sign in using Apple or Google.
• You are responsible for keeping your login credentials secure.
• You may delete your account in the App at any time. Deleting your account permanently removes your flashcards and study data.
• Deleting your account or uninstalling the App does not cancel your subscription (see Section 4).

4. Subscriptions, Unlimited Plan & Fair Use

• The App offers free and paid tiers, including "Unlimited" subscription plans.
• Fair Use Policy (FUP): The "Unlimited" plan is intended for individual, non-commercial human use only. We reserve the right to throttle, limit, or suspend accounts that exhibit bot-like behavior or generate an unreasonable volume of content (e.g., generating thousands of quizzes in an hour) to prevent abuse and protect our service limits.
• Purchases are processed securely by Apple or Google.
• Subscriptions renew automatically unless cancelled in your account settings.
• Right of Withdrawal / Easy Cancellation: You can manage or cancel your digital subscription at any time directly through the App's settings or via the device's 'Manage Subscriptions' page for a frictionless cancellation process.
• Refunds are handled by Apple or Google according to their respective policies.

5. Third-Party Services, Analytics & Marketing

The App relies on third-party services, including Apple, Google, Firebase, RevenueCat, PostHog, and the TikTok Business SDK. Your use of these services is subject to their own terms and privacy policies.

• Analytics: We use PostHog for product analytics. We have disabled all session recording/screen-replay features.
• Marketing & Measurement: We use the TikTok Business SDK to measure the effectiveness of our advertising and to find new users. This tracking is subject to your explicit consent via the iOS App Tracking Transparency (ATT) prompt. You can manage your preferences in your device settings.

6. Intellectual Property

• All rights to the App and its software belong to us.
• You retain ownership of the flashcards and content you create or upload.

7. Limitation of Liability

• The App is provided “as is” without warranties.
• We do not guarantee that using the App will improve exam results or academic performance.
• To the maximum extent permitted by law, we are not liable for indirect or consequential damages.
• We are not responsible for the performance or technical delivery of third-party advertising platforms, including but not limited to TikTok, nor for the accuracy of their attribution modeling.

8. Termination

• You may stop using the App at any time.
• We may suspend or delete accounts that abuse the service or violate these Terms.

9. Governing Law

These Terms are governed by Polish law and applicable EU regulations.
